Hate Crimes

In October 2000, the New York State Legislature determined that violence, intimidation and destruction of property based upon bias and prejudice have become more prevalent in New York state. In these “hate crimes,” victims are intentionally selected because of their race, color, national origin, ancestry, gender, religion, age, disability or sexual orientation. The New York Legislature declared that hate crimes should be prosecuted and punished with appropriate severity. At Addabbo and Greenberg, we have extensive experience defending those falsely accused of hate crimes. Attorney Todd Greenberg was a defense attorney for one of the young men charged in the infamous “Howard Beach case,” obtaining an acquittal on all felony charges against his client, who allegedly participated in a hate crime. Recently, Mr. Greenberg obtained an acquittal on all criminal charges against a defendant stemming from a highly publicized hate crime involving five defendants who were charged with assaulting a person because of his ethnic background. Mr. Greenberg’s client was the only defendant found not guilty of all criminal charges.

Here are some of the “Hate Crime” cases, which were defended by New York Criminal Defense Attorney Todd Greenberg:

Most recently, in a case where five men were convicted after a racially motivated assault, Mr. Greenberg’s client was the only Defendant acquitted of all criminal charges in the case.

A Hate Crime, also known as a Bias Crime is a Criminal Offense committed against a person, property, or society that is motivated, in whole or in part, by the offenders bias against a race, religion, disability, sexual orientation, or ethnicity/national origin.

In New York, being charged with a Hate Crime is a factor that can enhance the severity of the consequences for a conviction on other charges such as Assault, Domestic Assault, Property Damage and other crimes against individuals or property. The prosecution of a charge as a Hate Crime can make a bad situation even worse.
