Legal Options for Employees After an Accident on the Job

Employees who are injured on the job in Connecticut will usually be getting their benefits through the no-fault workers' compensation system administered by the Workers' Compensation Commission (WCC). In most cases this is the only way to access any benefits after an injury here in Hartford, CT, but it's always a good idea to talk with a work injury attorney. There are a few limited exceptions, and there are also occasions where it may be possible to bring a third-party claim.

Immediate Steps to Take After an Hartford, CT Workplace Accident

  • Report the injury to your employer or supervisor immediately
  • Seek medical treatment promptly
  • File Form 30C (Notice of Claim for Compensation) with the appropriate WCC district office and send a copy to your employer

Workers' Compensation Benefits

The idea behind workers' comp is that it doesn't matter who is at fault. Even if the injury is the employee's fault, the injured employee is still entitled to all reasonable and necessary medical treatment, including rehabilitation and prescriptions, and to temporary total disability compensation for lost wages during the time they can't work at all, which is generally 75% of their after-tax average weekly wage.

The trade-off is that the employer can't be sued if the injury was their fault, which means there's no way to recover 100% of wages or get anything for pain and suffering. In addition to the basic benefits, however, an injured worker could be entitled to temporary partial disability or wage differential when they can do some work but can't return to either their previous position or to full-time work. They can also be entitled to permanent partial disability if they can go back to work but not at the position they had before.

Things to Know About Workers' Comp Benefits

Benefits are generally not taxable, and if your claim is contested or the payments stop before they should, you can request an informal hearing or even an emergency hearing in some situations. It's always wise to have a lawyer fighting on your side to ensure that you're getting all the benefits you're entitled to and for the full amount of time you're entitled to have them.

When You Can Sue

Intentional Tort

This is where the employer actually intended to injure the employee or intentionally created a hazardous condition knowing full well that injury was substantially likely. Ordinary negligence or even recklessness isn't enough here, and it's very rare for an employee to successfully bring a claim for this. But it does happen.

No Workers' Comp

If the employer failed to carry the required workers' compensation insurance, then they aren't protected against lawsuits.

Third-Party Claims

If a third party's negligence caused or contributed to the injury, then you can bring a civil claim for personal injuries and seek damages that aren't available in workers' compensation.

9/28/26 Nassau County Jury: “NOT GUILTY“ DWI

Our client, a 30-year-old businessman, was stopped for speeding. The police officer allegedly smelled alcohol and eventually arrested the client, who blew a .12  on the breath test. Mr. Greenberg argued to the jury that despite the reading, our client’s physical appearance and characteristics were stronger; therefore, the instrument was not accurate. Mr. Greenberg also argued to the Jury that our client's BAC was higher at the time of the test, one hour after he was stopped, than at the time he was driving, because of the absorption of the alcohol into his blood during that one-hour period. The Jury did find the defendant guilty of driving while impaired, which is what we were requesting of the Nassau County District Attorney Office to plead to. The District Attorney wouldn’t give it, but the Jury did!
