The Defendant was charged with Two Counts of Operating a Motor Vehicle while Intoxicated and Operating a Motor Vehicle while Impaired. It was alleged that on December 5, 2009, at the Queens Midtown Tunnel, the Defendant was operating his vehicle when a Police Officer observed the Defendant and alleged that the Defendant had watery and bloodshot eyes and an odor of alcohol on his breath. Thereafter, the Defendant blew a .11 at Central Testing.
