A “Not Guilty” verdict was rendered to the charge of Murder 2 nd degree at a trial wherein Criminal Defense Attorney Todd Greenberg presented the Defense of Extreme Emotional Disturbance with Expert Witness, Forensic Psychiatrist Dr. Sasha Bardey. The finding of Extreme Emotional Disturbance reduces the charge of Murder in the Second Degree, which carries a life sentence, to Manslaughter in the First Degree, with a sentencing range of 5 to 25 years.  Mr. Greenberg presented a Sentence Memorandum and researched other cases where the Extreme Emotional Disturbance was so severe that Appellate Courts reduced maximum sentences to minimum sentences. Although the District Attorney asked for a 22-year sentence, on July 23, 2025, relying on the cases presented by Mr. Greenberg, the Defendant was sentenced to 6 years’ incarceration! This is a very sad case wherein our client was travelling in upstate New York when her car was rear ended by a tractor trailer which failed to stop in traffic. Under New York’s archaic Wrongful Death statute, the Estate could only recover for conscious pain and suffering and loss of the deceased’s monetary value to her family. Through the use of a Pathologist and Reconstruction expert, Mr. Greenberg was able to establish conscious pain and suffering measured in seconds. The Deceased was heard by a relative who was in the same vehicle but not seriously physically injured saying “help me, help me, please help me”. The Defendant was charged with Conspiracy to Defraud Financial Institutions, a Class “B” Federal Felony, along with several other co-conspirators. Several banks were the victims of this multimillion dollar Mortgage Fraud. The Federal guidelines called for a range of imprisonment of approximately five years. Due to a Motion by Federal Criminal defense Attorney Todd Greenberg, United States District Judge Peter G. Sheridan departed from the Federal sentencing guidelines on the ground that the Defendant’s father, a co-defendant and leader of the conspiracy, strongly influenced his son. Confucius set up five principles relationships in which people are involved, one of them being “father and son”. In passing sentence, the Court noted this relationship, the trust between this Defendant and his father, and departed considerably from the Federal Guidelines, finding the father’s influence contributed to the Defendant’s actions. In a major legal victory in Federal court in Buffalo, Attorney Todd D. Greenberg, Esq., along with Buffalo Attorney Mark J. Mahoney, Esq., who represented a Co-defendant, obtained suppression of evidence found in a search of Mr. Greenberg’s client’s home, including pictures of Nike sneakers, financial records and approximately $450,000 in cash. Addabbo and Greenberg’s client was charged, along with 22 other alleged co-conspirators, with Trafficking in Counterfeit Goods and Conspiracy. The Indictment alleged that the Conspiracy involved a violation of Nike, Inc. trademarks. It was alleged that Addabbo & Greenberg‘s client, with others, “…devised and engaged in a criminal scheme to traffic in millions of dollars of footwear bearing counterfeit Nike marks.” An arrest warrant was issued from the Federal Court in Buffalo and our client was arrested in his home in Flushing. During the search, Federal agents recovered photos of Nike sneakers, financial records and $450,000 in cash. The Government argued that the seizure was lawful under the “plain view” doctrine, which states, in substance, that if the police are lawfully in a position from which they view an object, if its incriminating character is immediately apparent, and if the officers have a lawful right of access to the object, they may seize it without a warrant. After extensive pretrial hearings in Buffalo, the court found, as argued by Attorney Todd. D. Greenberg, Esq., that the agents had no reason to be in those portions of the apartment from which the items were seized because they arrested the defendant at his doorway. Further, with regard to the “plain view” argument by the Government, the Court noted that this alleged “plain view” seizure, where the incriminating nature of the items must be “immediately apparent”, took two hours, as established during Mr. Greenberg’s cross examination of the Federal Agent. Under such circumstances, the Government could not sustain its burden of establishing that the incriminating nature of the items were “immediately apparent”. It should be noted that 18 of the other defendants pleaded guilty and now, after the granting of this suppression motion, Mr. Greenberg’s client stands a good chance of a dismissal of the case. Our client, a 28 year old female, was charged with Domestic Violence in that she allegedly hit an scratched the Complainant, her live-in boyfriend, with whom she has a child and who is a New York City Firefighter. On July 8, 2013 a Queens Criminal Court Judge granted the motion of Queens Criminal Defense Attorney Todd D. Greenberg to suppress the results of a breathalyzer on the ground that the Defendant’s limited right to counsel was violated. After a fact finding hearing and legal argument based on extensive research on this issue, the Judge held that Defendant’s right to counsel was violated when the Defendant, at the breath test, stated “I would like a lawyer present”. Attorney Todd D. Greenberg provided case law to the Court that established a limited right to counsel where the Defendant requests counsel. In the case at bar, the Court held that “the Defendant repeatedly attempted to invoked his limited right to counsel by requesting that his attorney be present and police officers (names omitted) ignored these requests.” Once again, based upon knowledge of the law in Driving While Intoxicated cases, a major part of evidence against this Defendant in a Drunk Driving case, which was wrongfully and unconstitutionally obtained, was suppressed. On April 5, 2011, the City of New York settled an accident negligence claim by an eleven year old boy whose leg was run over by a Fire Department vehicle for $250,000.00. On August 25 th 2006, in Far Rockaway, Queens a Fire Department vehicle negligently ran over the leg of an eleven year old who was tying his shoe at a gas station. Luckily, although the eleven year old suffered serious tissue injury, there we re no fractures and there was a full physical recovery. The infant Plaintiff suffered extensive soft tissue loss on part of his leg which was repaired by a skin graft surgery leaving considerable scaring. Attorney Todd D. Our office settled a Dram Shop and Negligence action at mediation against a Queens bar and patron when the bartender served alcohol to that visibly intoxicated patron who later caused our client injuries in a car accident. Plaintiff, a 32-year-old female, was out with friends, all of whom were heavily drinking. A witness who was at the bar testified that the male patron and driver of the vehicle couldn’t even stand up yet was served drinks. Immediately thereafter, the patron, two of his friends and Plaintiff got into a vehicle which then crashed into parked cars causing Plaintiff to get a serious cut and now scar across her forehead. Addabbo & Greenberg continues to serve the community and recover for those injured by the negligence of others.

A highly litigated case alleging negligent security, which included 2 appeals to the Appellate Division, Second Department, was settled on the eve of trial for $550,000.00. The Decedent was targeted and shot in the head when the murderer entered a high rise building “piggy backing” tenants. Attorney Todd D. Greenberg alleged a failure of the security officers to properly screen visitors. Even though it was a targeted killing, and the decedent was shot in the head and died immediately, Mr. Greenberg was able to argue that the deceased suffered pre-impact terror when, as Mr. Greenberg emphasized, the shooter stated in his confession to a NYPD Detective “so we chased him down a little bit”. The Decedents’ mother and father, our clients, were very thankful that the lack of proper security was acknowledged and for the compensation given to their son for his conscious pain and suffering in anticipation of his death as he ran approximately 12 feet from his attacker.
